1. Who we are and when these terms apply
These terms and conditions apply to every order you place through the Marnie Thorp online store. The seller and your contracting party is ML ECOM OPERATIONS B.V., Prins Frederik Hendriklaan 84, Naarden, Noord-Holland, 1411 GB, Netherlands, registered with the Dutch Chamber of Commerce under KvK number 96592710, VAT number NL867675342B01. Our store is provided technically through Shopify.
By placing an order you confirm that you are at least 18 years old and legally able to enter into a contract.
2. How a contract is formed
The display of products in our store is an invitation to treat, not a legally binding offer. When you submit your order you are making a binding offer to purchase. A contract is formed only once we expressly confirm your order or dispatch the goods. We may decline an order without giving a reason — for example where an item is unavailable, where a price has been listed in error, or where we suspect fraudulent use of a payment method. If we decline an order after payment has been taken, we will refund you in full.
3. Prices and payment
All prices are shown in pounds sterling (GBP) and include UK VAT where applicable. Delivery is free on all UK orders; where any charge applies it is shown separately before you pay. The price that applies is the one displayed at the time of your order and confirmed in your order confirmation.
The payment methods we accept are shown during checkout and set out in full in our Payment Policy. Your payment method is charged when you place your order.
4. Delivery
Processing takes 2–3 working days and transit a further 4–9 working days, giving a total estimated delivery of 6–12 working days (Monday to Friday, excluding public holidays). Full details, including how import VAT is handled for consignments over £135, are set out in our Shipping and Delivery Policy. Delivery estimates are estimates and not guarantees. We are not liable for delays outside our reasonable control, such as carrier disruption, customs processing or severe weather. Risk in the goods passes to you on delivery.
5. Cancellation and returns
As a consumer you have a statutory right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. In addition we offer a voluntary 30-day return period. 6. Your legal rights in the goods
Under the Consumer Rights Act 2015 the goods we supply must be of satisfactory quality, fit for purpose and as described. If they are not, you have a 30-day short-term right to reject them for a full refund, and rights to repair, replacement or a price reduction after that period. Nothing in these terms affects those rights. Please contact us as soon as you become aware of a problem.
7. Retention of title
The goods remain our property until they have been paid for in full.
8. Product descriptions and images
We take care to describe and photograph our products accurately. Colours and finishes may nevertheless appear differently depending on your screen and its settings. Measurements given in size guides are approximate and subject to normal manufacturing tolerance.
9. Our liability
We do not exclude or limit our liability in any way where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for breach of your statutory rights as a consumer. Subject to that, we are liable for loss you suffer that is a foreseeable result of our breaking these terms, and we are not liable for loss that is not foreseeable or that arises from your own misuse of the goods.
10. Acceptable use of this website
All content in this store — in particular text, images, graphics, logos and trade marks — is protected by copyright and may not be reproduced or used without our prior written consent. You may not use the store for any unlawful purpose, attempt to gain unauthorised access to it, or interfere with its operation.
11. Your personal data
How we handle your personal data, including the cookies and tracking technologies we use, is set out in our Privacy Policy.
12. Relationship with Shopify
Our store is provided technically through Shopify. All purchases are made directly with ML ECOM OPERATIONS B.V. Shopify is not a party to your contract and is not responsible for it.
13. Governing law and complaints
These terms are governed by the laws of England and Wales, and you may bring proceedings in the English courts. If you live in Scotland or Northern Ireland, you may instead bring proceedings in your own courts. If you are resident in the European Union, you keep the benefit of any mandatory consumer protection provisions of the law of your country of residence.
If something has gone wrong, please contact us first — we aim to resolve complaints within 14 days of receiving them.
14. Changes to these terms
We may amend these terms from time to time. The version that applies to your order is the version in force at the time you place it.
